The High Court of Justice of Aragon has ratified the sentence of two years in prison to a woman from Zaragoza for defrauding a friend of 34,400 euros from whom he asked for money alleging false personal and family problems. Among the excuses used were the alleged illness and subsequent death of his mother in Romania.
According to the Judiciary, the defendant met the injured party in August 2023 in Zaragoza and the two began a close friendship, even having sexual relations. Taking advantage of this relationship of trust, the woman falsely assured him that she worked in the Romanian consulate and in a law firm and began to ask him for money with the promise of returning it.
Among the amounts requested are transfers of 6,000, 2,000, 2,000 and 1,000 euros for alleged medical and hospital expenses of his sick mother in Romania. Later he asked her for another 10,000 euros to travel urgently to the country after the alleged death of his mother and to cover the funeral expenses. None of those circumstances were true. In addition, the victim gave him cash withdrawn from an ATM on several occasions in the face of new excuses and invented problems.
The Civil and Criminal Chamber of the TSJA considers both the money delivered and the deception used to obtain it to be accredited. The resolution concludes that the woman did not intend to return the amounts from the beginning and finds sufficient evidence of her profit motive and her responsibility in the crime.
The sentence is not yet final and can be appealed in cassation before the Supreme Court.
